The FIRST PARTY (Employer/Agent Abroad) shall issue a Demand Letter to the SECOND PARTY (Link Star), clearly stating the number of workers required, job categories, salary rates, and other employment conditions. This shall be accompanied by a Power of Attorney, Guarantee Letter, Manpower Recruitment Agreement, and Employment Contracts, authorizing the SECOND PARTY to recruit and deploy workers from Nepal. The Demand Letter and Power of Attorney must be duly attested by the Chamber of Commerce of the employing country, its Ministry of Foreign Affairs, and the Nepal Embassy.
2.Government Approvals
Both parties shall obtain all necessary approvals from their respective governments in accordance with applicable rules and regulations governing foreign employment and manpower supply.
3.Candidate Shortlisting
The SECOND PARTY shall be responsible for shortlisting candidates based on the qualifications and experience required by the FIRST PARTY. The SECOND PARTY will notify the FIRST PARTY of the shortlisted candidates who are ready for final interviews and selection.
4.Selection Rights
The FIRST PARTY may either send a representative to conduct interviews or authorize the SECOND PARTY to carry out the selection process on its behalf. In either case, the SECOND PARTY guarantees the competency of the selected workers.
5.Final Selection and Mobilization
Selected candidates shall be confirmed by the FIRST PARTY through fax, email, or official letter, along with the intended mobilization date. Candidates will be interviewed, tested, and selected either by the FIRST PARTY's representative or by the SECOND PARTY on its behalf.
6.Pre-Departure Formalities
The SECOND PARTY shall facilitate all required formalities for the selected workers, including Nepalese immigration procedures, medical examinations, visa stamping, and other necessary government approvals.
7.Departure and Notification
The SECOND PARTY shall provide airport assistance to the departing workers and promptly inform the FIRST PARTY of the workers’ travel details via fax, email, or telephone.
8.Reception and Arrival
The FIRST PARTY shall be responsible for receiving the deployed workers at the destination airport, either individually or in groups, as per the visa validity and employer’s schedule.
9.Wages and Service Conditions
The worker’s monthly salary and service conditions shall be as specified in the Demand Letter and Employment Contract. The FIRST PARTY must inform the SECOND PARTY of all salary components and applicable deductions (e.g., taxes), which the SECOND PARTY shall communicate to the worker.
10.Probation and Replacement
Within the first three months of employment, if a worker is found to be medically unfit, unqualified, unwilling to work, or considered a security risk, the FIRST PARTY may request a replacement. The SECOND PARTY shall replace the worker within one month of termination, at its own expense.
11.Mobilization Timeline
The mobilization of selected workers shall be completed within one month of visa issuance. In case of delays beyond this period, the visa may be cancelled, and the SECOND PARTY shall bear all associated governmental expenses for replacement.
12.Employer Default Clause
If a worker does not receive the agreed-upon employment conditions per the Employment Contract, or if the employing company ceases operations before the contract ends, the FIRST PARTY shall replace the affected worker at its own expense.
